Our conveyancing matters are carried by Faye Beech who is Trainee solicitor with over 5 years experience in residential conveyancing. George Patrick Nicholls is a qualified solicitor with over [ ] years’ experience and supervises our residential conveyancing matters.

We offer fixed fee conveyancing, meaning that the price we quote you upfront is the price you will pay unless there are unforeseen circumstances, in which case we will inform you of any additional cost at the earliest opportunity.

Our costs information set out below is made up of our fees, plus the disbursements you will be expected to pay depending on which type of matter we are dealing with for you. The disbursements are paid to third parties, such as HM Land Registry.

Nicholls Solicitors have recently joined Certainty, the National Will Register and it is therefore our standard practice to register wills on this database to ensure that your executors or beneficiaries can locate this in the future. We are also able to undertake searches using Certainty to safeguard executors whom we act for in probate matters to ensure that the will they are proving is the most recent will for the deceased. We believe that being part of Certainty adds benefit to our clients.

 

PRICING FOR NON-CONTENTIOUS PROBATE WHERE ALL ASSETS ARE LOCATED IN THE UK AND THE DECEASED IS DOMICILED IN ENGLAND AND WALES

Probate and Estate Administration

Our charges are made on a time and trouble basis which means that our costs in any particular matter will depend upon the amount of work involved.

Our charges set out below are therefore estimated and a likely range of the costs is given based upon our experience of dealing with the Administration of Estates over many years.

These charges are exclusive of disbursements. Disbursements will also be incurred in addition to costs, and the disbursements are set out in a separate section below.

We currently offer a choice of three services :

Obtaining a Grant of Probate or Letters of Administration (where there is no inheritance tax to pay)

£450 plus vat to £900 plus vat

This service is essentially for clients who wish us to assist in obtaining a Grant of Probate or Letters of Administration but do not wish us to deal with the other matters required in the Administration of an Estate.

This service includes :

  • Obtaining from the client a value of the Estate
  • Completing forms IHT 205 and IHT 217
  • Preparing an Oath
  • Applying for a Grant of Probate or Letters of Administration

The factors that will affect the cost are :

  • Whether there is a valid Will. If there is not, this will increase the costs
  • the number of assets and liabilities in the Estate
  • the number of letters and emails written and received and telephone calls made and received

This service does not include :

  • writing to any third parties such as banks, shares registrars, pension providers, utility companies etc.
  • searching for beneficiaries
  • estates where it is necessary to complete an IHT400 form (as opposed to an IHT 205 Form above) which is a far more comprehensive document
  • dealing with income tax or capital gains tax
  • collecting in assets or settling liabilities
  • transfer of any property
  • distributing the estate
  • preparing an Estate Account
  • dealing with any trust matters arising in the estate

Estate Administration Service (where there is no inheritance tax to pay)

£1,500 plus vat to £4,500 plus vat

This service includes :

  • reviewing all documents relating to the Estate
  • carrying out a Certainty Will search
  • placing Section 27 Trustee Act 1925 Notices
  • writing to all banks, shares registrars, utility companies etc
  • completing forms IHT 205 and IHT 217 or IHT 400.
  • preparing an Oath
  • applying for a Grant of Probate or Letters of Administration
  • collecting in the assets
  • settling any liabilities
  • dealing with income tax and capital gains tax matters and where appropriate instructing an accountant
  • paying any legacies
  • arranging the transfer of property
  • preparing an Estate Account
  • distributing the Estate

The factors that will affect the cost are :

  • whether there is a valid Will. If there is not, this will increase the costs
  • the number of assets and liabilities in the Estate
  • the number of beneficiaries and their geographical location
  • the number of letters and emails written and received and telephone calls made and received
  • whether it is necessary to complete an IHT400 form (as opposed to an IHT 205 Form above) which is a far more comprehensive document, and this will increase the costs

This service does not include :

  • dealing with any trust matters arising in the estate.
  • dealing with complex income tax and capital gains tax issues or the costs of an accountant where necessary to deal with these matters
  • conveyancing of land where property in the Estate is to be sold or mortgaged

Estate Administration where there is inheritance tax to pay

£2,500 plus vat to £7,500 plus vat

This service includes :

  • reviewing all documents relating to the Estate
  • carrying out a Certainty Will Search
  • placing section 27 Trustee Act 1925 Notices
  • writing to all banks, shares registrars, utility companies etc
  • completing forms IHT 400 Form.
  • arranging for the payment of inheritance tax
  • preparing an Oath

  • distributing the Estate

Charging rates

£150 per hour for our time

£15 for letters and emails written

£15 for telephone calls made and received

£7.50 for letters and emails received

 

Disbursements

In addition to the costs set out above, there will also be some disbursements to pay as below :

  • Client ID verification £6 per person
  • HMCTS fees for a Grant of Probate or Letters of Administration £155 plus 50p per additional copy.
  • Cost of swearing the Oath £5 to £7 per Executor or Administrator
  • Cost of a Certainty Will search £114
  • Cost of Section 27 trustee Act Notices estimated at £200 to £300 (depending upon requirements).
  • Probate Consultant to where required estimated at £60 to £120 (depending upon requirements).

Alternative dispute resolution seeks to settle cases before proceedings are issued if possible, but, if not, before trial. It aims to deal with cases before they become too embroiled in the court system. It aims to save costs.
There are many forms of alternative dispute resolution such as formal mediation, round table settlement meetings and negotiations in correspondence.

Funding is also a key issue in litigation cases. It is important to consider whether you have any before the event legal expenses insurance to provide cover for your legal costs. This can be contained in your household or car insurance policy or other policies or even policies of family members. Very often people do not know that they have this. If you do not have before the event legal expenses insurance then we can investigate whether we can obtain after the event legal expenses insurance to deal with your case.
